1. Introduction

  • Growers Hub Cooperative Limited (“Growers Hub”, “the Cooperative”, or “the Organiser”) operates the Growers Hub Markets (“the Market”) in Wagga Wagga, New South Wales.
  • Growers Hub is a non-distributing cooperative that exists to support regional producers, makers, and creatives. The Market forms part of the Cooperative’s community and economic development activities, providing a platform for local enterprise and public engagement.
  • The Market is coordinated by the Market Management Committee, which is comprised of Growers Hub members and directors and operates under the authority of the Growers Hub Cooperative Limited (the Organiser). The structure or composition of this committee may be varied by the Organiser from time to time.
  • These Terms and Conditions (“the Terms”) govern the participation of all stallholders, vendors, exhibitors, and performers (collectively, “Traders”) at the Market. Submission of an application signifies agreement to be bound by these Terms once Growers Hub confirms acceptance of the Trader’s application. 

2. Market Overview

  • The Market is conducted at Unit 5 / 180 Forsyth Street, Wagga Wagga NSW 2650, at the following regular times (subject to change or cancellation at the Organiser’s discretion):
    • Thursday Market: 1:00 pm – 6:00 pm
    • Friday Market: 5:00 pm – 9:00 pm
    • Saturday Market: 8:00 am – 12:00 pm
  • Additional or special event markets may be held by prior notice from the Organiser.

3. Eligibility to Trade

  • The Market is intended primarily for genuine producers, growers and makers operating within the Riverina region.
  • Eligible Traders include primary producers, value-added food makers, artisans, and approved community or educational initiatives consistent with the Cooperative’s objectives.
  • The resale of imported, mass-produced, or wholesale goods is prohibited unless expressly authorised in writing by the Organiser.
  • Acceptance and stall allocation are at the sole discretion of the Organiser, which may refuse or revoke a Trader’s participation at any time, acting reasonably, including for reasons of safety, compliance, conduct, suitability of goods, or operational requirements. While Growers Hub is not required to provide detailed reasons for its decision, it will act fairly and in the interests of the Market as a whole. 

4. Application Process

  • Applications must be submitted via the official online Growers Hub Trader Application Form
  • Each application must include a valid ABN, $20 million Public Liability Insurance, relevant Product Liability Insurance, Food Safety or Liquor Licences, and a list of goods for sale.
  • Traders must obtain written approval for each product line prior to sale.
  • Approval to trade is personal and non-transferable. Any change in ownership or business structure requires a new application.

5. Fees and Payment

  • Stall fee: $35 per standard site, per Market.
  • Fees are payable no later than 14 calendar days before the booked Market date.
  • Payment must be made via Issimo. EFT and cash payments are not accepted.
  • Cancellation Policy:
    • More than 7 days’ notice: full refund or credit.
    • Less than 7 days’ notice: fee forfeited unless the site is reallocated.
    • No refund for non-attendance.
    • Markets cancelled by the Organiser may be credited or refunded at its reasonable discretion.

6. Insurance and Compliance

  • Traders must maintain Public Liability and (where applicable) Product Liability Insurance of at least $20 million.
  • Traders must comply with all relevant NSW and Commonwealth laws, including the Food Act 2003 (NSW), Australian Consumer Law, and all Work Health and Safety (WHS) legislation and requirements.
  • All electrical equipment must be tested and tagged in accordance with applicable safety standards and regulations, and all gas appliances must be maintained in good working order and operated safely. The Organiser may prohibit the use of any unsafe or non-compliant equipment. 
  • The Organiser may inspect compliance documentation or stalls at any time and suspend trading until satisfactory evidence of compliance is provided.

7. Permits, Licences and Certifications

  • Traders must hold, and maintain at all times, all permits, licences, and registrations as required by Local, State, and Federal law, including but not limited to:
    • Wagga Wagga City Council
    • NSW Foot Authority
    • SafeWork NSW (where applicable). 
  • Traders must also maintain: 
    • Public Liability Insurance for a minimum of $20 million, and where applicable, Product Liability Insurance; and 
    • Any certifications claimed in relation to their products (e.g. organic, biodynamic, or other recognised standards).
  • Traders must comply with all requirements relating to:
    • Fair Trading legislation 
    • Product labelling laws 
    • Weights and measures requirements 
    • Health registration obligations

8. Verification of Information

  • Review of documentation or certifications
  • Consultations with relevant regulatory bodies
  • Site visits or inspections (see clause 10 below). 
  • The Market Management Committee reserves the right to verify any information provided by Traders, including but not limited to through: 
  • Traders must notify the Market Management Committee immediately of any significant change in circumstances that affects their application, permits, certifications, or ongoing compliance. 

9. Products for Sale

  • Only products approved in writing by the Market Management Committee (acting under the authority of the Organiser) may be sold at the Market. 
  • Products must comply at all times with the conditions set by the Market Management Committee. 
  • The sale of unapproved products is strictly prohibited. 
  • Traders must seek written approval for any new or changed product lines prior to sale. 

10. Site Visits 

  • Traders agree to permit representatives of the Market Management Committee or the Organiser to visit their premises—or the premises of any producer for whom they are an approved agent—at a mutually agreed time during normal business hours, for the purposes of verifying product origin, production methods, or compliance with these Terms.

11. Stallholder Signage 

  • Traders must clearly display signage showing their trading name, product prices, and all required weights and measures information. 
  • Growers Hub signage must also be displayed, identifying product categories as follows: 
    • Green signs – producer products
    • Orange signs – agency products
    • Purple signs – certified organic products 

12. Market Operations

  • Setup & Pack Down: setup may commence no earlier than 90 minutes prior to Market open time; vehicles must exit site at least 30 minutes before opening, and no vehicle movement is permitted during trading unless authorised by Growers Hub for safety or emergency reasons. Traders must park off site during Market hours.
  • Trading: stalls must be attended for the full session and kept clean and tidy. Packing up early without prior approval may result in future stall allocations or applications being cancelled.
  • Waste: traders must remove waste and avoid single-use plastics.
  • Power: Use of electrical and/or gas must be pre-approved by Growers Hub. All electrical and/or gas equipment must comply with clause 6 (Insurance and Compliance) and any directions issued by Growers Hub relating to safety. 

13. Trader Conduct

  • Traders must behave professionally and respectfully toward customers, Growers Hub team members, volunteers and other Traders. 
  • Aggressive, abusive, or discriminatory behaviour may result in immediate removal or suspension from the Market.
  • All advertising and labelling must be accurate and not misleading.
  • Prices must be clearly displayed on all products.
  • Claims such as “organic”, “chemical-free”, or similar must be true, substantiated and labelled accordingly.
  • Public statements affecting the Market must follow the internal dispute process.
  • Traders acknowledge having read and understood the Growers Hub Culture & Core Values Commitment and agree to uphold these values in all dealings with Growers Hub, customers, and other Traders. Conduct that is materially inconsistent with this commitment may be treated as a breach under Clause 17 (Breaches and Disciplinary Action). 

14. Branding and Intellectual Property

  • The name “Growers Hub” and related branding are owned by the Cooperative.
  • Traders may only use Growers Hub branding with prior written approval.
  • Unauthorised use is prohibited.

15. Absence, Weather, and Force Majeure

  • Traders must promptly notify the Market Coordinator if unable to attend.
  • The Organiser may cancel or postpone Markets for safety, weather, or other operational reasons beyond its control.
  • The Organiser is not liable for loss arising from cancellations, except as required by law

16. Health, Safety, and Fire

  • Traders must comply with Work Health and Safety requirements.
  • Cooking stalls must have a 2 kg ABE extinguisher and fire blanket.
  • Hot appliances must be positioned safely.
  • Smoking is prohibited within the Market area.

17. Breaches and Disciplinary Action

  • If a Trader breaches these Terms, Growers Hub may take appropriate action, which may include giving a verbal warning or written warning, suspending trading rights at the Market, or terminating participation.
  • Serious breaches may result in immediate suspension or termination.
  • Before suspension or termination (unless urgent action is required for safety or serious misconduct), Growers Hub will give the Trader notice of the issue and a reasonable opportunity to respond.
  • The Organiser’s decisions are final.

18. Dispute Resolution

  • Grievances must be submitted to the Organiser in writing within 7 days of the issue.
  • The Market Coordinator may refer matters to the Cooperative.
  • Cooperative decisions made under this process will be final and binding unless otherwise required by law.

19. Liability and Indemnity

  • Traders participate at their own risk.
  • Growers Hub is not liable for loss, theft, or damage to property, except to the extent caused by its own negligence or as otherwise required by law.
  • Traders indemnify Growers Hub, its staff, and volunteers against all claims arising from their activities, to the extent permitted by law.
  • Nothing in these Terms limits or excludes any rights or remedies available under the Australian Consumer Law. 

20. Acceptance

  • By submitting the Growers Hub Trader Application Form and/or attending the Market, the Trader acknowledges having read, understood, and agreed to these Terms and Conditions.
